A 2ND AMEND SANCTUARY STATE



WHEREAS, the Constitution for the United States of America is the supreme law of our nation and the Second Amendment to the Constitution states, “A well-regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms shall not be infringed”; and


WHEREAS, the Constitution of the State of Wyoming, Article 1, Section 24 states, “The right of citizens to bear arms in defense of themselves and of the state shall not be denied”; and


WHEREAS, the right of the citizens to keep and bear arms is guaranteed as an

individual right under the Second Amendment to the United States Constitution and under the Constitution of the State of Wyoming; and


WHEREAS, the right of the citizens to keep and bear arms for the defense of life, liberty and property is regarded as an inalienable right by the citizens of Wyoming; and


WHEREAS, the citizens of Wyoming derive economic benefit from all safe forms of firearm recreation, hunting and shooting conducted within Wyoming as secured under the United States and Wyoming Constitutions; and


WHEREAS, it is the desire of the Republican Party of Wyoming to declare its support of the Second Amendment to the Constitution for the United States of America and Article 1, Section 24 of the Constitution of Wyoming protecting citizens’ inalienable and individual right to keep and bear arms; and


WHEREAS, the members of The Wyoming Legislature took an oath to support, obey and defend the Constitutions of the United States and the State of Wyoming;


NOW, THEREFORE, BE IT RESOLVED that the Republican Party of Wyoming strongly supports the Second Amendment of the Constitution for the United States of America and Article 1, Section 24 of the Constitution of the State of Wyoming and that the Republican Party of Wyoming declares:

that it is an inalienable right of the people of Wyoming to keep and bear arms for the defense of life, liberty and property; and


(a) that all federal and state acts, laws, executive orders, administrative orders, court orders, rules, regulations, statutes or ordinances that infringe on the people's right to keep and bear arms as guaranteed by the second amendment of the constitution for the United States of America and article 1, section 24 of the Wyoming constitution, shall be invalid in this state, shall not be recognized by this state, shall be specifically rejected by this state and shall be considered null, void and of no effect in this state; and


(b) It shall be the duty of the courts and law enforcement agencies of this state to protect the rights of law abiding citizens to keep and bear arms within the borders of this state and to protect these rights from infringement; and


(c) No person, including any public officer or employee of this state or any political subdivision of this state, shall impinge on the legal and lawful right of the people to keep and bear arms, and nothing in this resolution may be construed to prohibit or otherwise limit a public officer or employee of this state or any political subdivision of this state from cooperating, communicating, or collaborating with a federal or state agency or performing his or her duty under his or her oath of office so long as the primary purpose is not to enforce any federal or state acts, laws, executive orders, administrative orders,

court orders, rules, regulations, statutes or ordinances infringing on the right of the people to keep and bear arms.


(d) for purposes of this resolution, "law abiding" means an individual who is not

otherwise precluded under state law from possessing a firearm; and


BE IT FURTHER RESOLVED, that no Wyoming money, resources or personnel shall be used in a manner contrary to the Second Amendment to the United States Constitution or Article 1, Section 24 of the Constitution of the State of Wyoming;


BE IT FURTHER RESOLVED, that to defend the rights and liberties of the citizens of Wyoming, the Republican Party of Wyoming hereby declares, and calls upon the Wyoming Legislature to declare:


Wyoming a “Second Amendment Sanctuary State”
